The “offer”, legally known as California Residential Purchase Agreement and Joint Escrow Instructions (CAR FORM RPA-CA) is a complex legal document with many moving parts, and contrary to popular belief they do not always boil down to price.

If two offers are identical what makes a seller select one offer vs. the other? There are many factors that are taken into consideration from the motivation of the seller to deadlines, market conditions, inventory levels, and contingencies that can make or break the deal.

Let’s talk seller motivation for a moment, why are they selling? What is truly important to them? What are their timeframes we can help meet as a team? Will this be an out of state move, or local corporate relocation.

Is this a “happy sale” or are they selling due to job loss, furlough, divorce, or death, etc? In other words, perhaps selling during tough times. It’s crucial for your team to understand the seller’s “why” to help position you in the “right-light.”

Some sellers are emotionally attached to a house, where others are simply attached to a bottom-line or deadline. It’s important for your team to know their audience. You may not want to write an emotional letter stating all the things you absolutely love about their house to an investor or a seller selling due to a recent painful, personal, emotional loss.

In these cases, a letter divulging too much emotion may be inappropriate or even hurt the deal altogether. Tact is important.
